Judgment
This original application is registered suo motu on the basis of the news item titled "Arkavathi stretch at TG Halli Reservoir hits pollution rock-bottom" which had appeared in the ‘Bangalore Mirror’ dated 21.02.2024.
When the matter was taken up yesterday, we had noted the issue involved in the OA as under:

The news item relates to the deteriorating water quality of Arkavathi river in Karnataka. The news item discloses that the river stretch at TG Halli reservoir has recorded an all time high value of Biological Oxygen Demand (BOD) indicating the polluted water. The news item also refers to a recent water quality report of the river by Karnataka State Pollution Control Board showing that the BOD value has gone up to 21, the highest recorded since the Centre’s National Water Monitoring Program (NWMP) started in 2018. It discloses that the BOD value in December 2018 was recorded to be 4. It also mentions that high organic pollution has also surged since 2018 and the total coliform bacteria has also significantly gone up and faecal coliform bacteria has increased multifold.:
Since learned Counsel appearing for the Kerala State Pollution Control Board (KSPCB) had submitted that the same issue is pending before the High Court of Karnataka in W.P. No. 38218/2023, therefore, he was granted a day’s time to produce a copy of the order of the High Court.
Learned Counsel for the KSPCB has filed summary of the proceedings in W.P. No. 38218/2013 taken from the official website of High Court of Karnataka and referring to the various document, he has submitted that the issue involved in this OA is already pending before the High Court of Karnataka.
In order to avoid the parallel proceedings, we do not intend to proceed further in this OA.
The OA is accordingly disposed of.
