This application is for punishment of offence under Section 26 of the NGT Act for violation of order of this Tribunal dated 02.02.2023 in EA No. 01/2023 disposing of similar application of the applicant earlier on the subject of water pollution in river Satluj at Kartarpur Sahib, as reported in the media.

In the earlier order dated 2.2.2023, the Tribunal noted the earlier proceedings particularly order dated 22.01.2021 in O.A No. 916/2018, Sobha Singh & Ors. v. State of  Punjab & Ors.22.02.2021  (relating  to pollution of Sutlej), order in O.A No. 673/2018 and O.A No. 593/2017 (relating to river and water pollution) and orders passed in O.A No. 606/2018 (with regard to solid and liquid waste management) wherein Chief Secretaries of all the States/UTs appeared before the Tribunal for interaction about compliance status on the subject of liquid and solid waste management. The Tribunal directed further remedial action accordingly.

It is now stated that water pollution is still taking place and there is violation of order of the Tribunal, calling for punishment under section 26 of the NGT Act.

We have heard the applicant in person and considered the matter. We are of the view that in view of section 30 of the NGT Act, the complaint for punishment for offence under Section 26 of NGT Act can be filed before the Area Magistrate and not before this Tribunal.

Accordingly, this application stands disposed of.
