Heard both sides.
Having considered the contentions advanced, we are of the opinion that in view of the fact that the substantial prayer in the writ petition was for a consideration of request made by the petitioner for winding up of the society and since Exhibit P8 and P17 are admittedly pending before the project Officer (Coir), who is the functional Registrar as far as a Coir society is concerned, the issue has to be considered by the said officer in accordance with law.
The appeal is therefore disposed of with a direction to the 3rd respondent to consider and pass orders on Exhibits P8 and P17 representations, referred to in the writ petition, with notice to the society as well. Appropriate orders shall be passed taking note of the provisions of law as well as the materials, if any, placed on record by the parties. Orders shall be passed within a period of six weeks from the date of receipt of a copy of this judgment.
In the meanwhile, the Managing Committee shall be permitted to carryout the day to day functions of the society, which will also be subject to the order to be passed by the Registrar.
