Learned counsel for the petitioner, while questioning the order of transfer dated 25.08.2026 (Annexure P/1), whereby the petitioner has been transferred from the Agriculture Marketing Mandi Samiti, Kanker, District North Bastar Kanker, to the Agriculture Marketing Mandi Samiti, Patthalgaon, District Jashpur, on administrative grounds, submits that the petitioner is due to retire within 13 months from the date of issuance of the impugned transfer order. It is further submitted that the petitioner has already submitted a representation before the Managing Director. Therefore, the present petition may be disposed of with a direction to the competent authority to consider and decide the said representation.

Learned counsel appearing for respondent No.2, Mr. Shrivastava, submits that the representation submitted by the petitioner has already been forwarded by the Managing Director to the Chairman of the Board and is presently under consideration. He further submits that, keeping in view the impending date of retirement of the petitioner, the said representation shall be considered and decided in accordance with law within a period of 25 days.

In view of the aforesaid submissions, the present petition is disposed of with a direction to the Chairman of the Board to consider and decide the representation submitted by the petitioner, in accordance with law, within a period of 25 days from the date of receipt of a copy of this order.

It is made clear that this Court has not expressed any opinion on the merits of the representation. The competent authority shall take a decision independently and in accordance with law.

With the aforesaid direction, the writ petition stands disposed of.
