Order on Board

1.

Learned counsel for the Petitioner submits that the impugned transfer order dated 01.10.2026, whereby the Petitioner has been transferred from PIU, Mohla-Manpur-Ambagarh Chowki to PIU, Kabirdham, is arbitrary and has been issued without due consideration of his genuine family circumstances. It is submitted that the Petitioner's wife is posted as an Assistant Engineer at Nagar Palik Nigam, Rajnandgaon, his minor children are studying at Rajnandgaon, and his aged parents require regular medical care. Despite these circumstances, the Petitioner's representation dated 02.10.2026, seeking retention at his present place of posting or adjustment at Rajnandgaon or a nearby place, has not been considered. At this stage, learned counsel for the Petitioner prays that he may be permitted to submit a fresh representation before the competent Transfer Committee, with a direction to decide the same within a stipulated period.

2.

Learned State counsel submits that, in the event the Petitioner submits a representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy, raising all his grievances, the same shall be considered and decided in accordance with law within a period of 25 days.

3.

I have heard learned counsel for the parties and perused the material available on record.

4.

Considering the nature of the grievance raised by the Petitioner and the submissions advanced by learned State counsel, this Court, without expressing any opinion on the merits of the case, deems it appropriate to dispose of the present writ petition with a direction to the Petitioner to submit a representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy within a period of 10 days from today. In the event such representation is submitted within the aforesaid period, the Transfer Committee shall consider and decide the same by passing a reasoned and speaking order, strictly in accordance with law and the applicable Transfer Policy, preferably within a period of 25 days from the date of receipt of the representation.

5.

With the aforesaid directions, the present writ petition stands disposed of.
