This OA is filed with a prayer to declare the shorlisting criteria adopted by the respondents for the purpose of selection to the post of Assistant Public Prosecutor (APP) for the Govt. of NCT of Delhi, as illegal, arbitrary and unjustified and to direct the respondents to consider the candidature of the applicants, to the post of APP, in accordance with their merit. The applicants have also raised several other grounds to challenge the shortlisting criteria.
The respondents filed a counter affidavit, opposing the OA. It is stated that the shortlisting criteria were adopted by the UPSC, in accordance with the procedure in vogue and having regard to the number of candidates who are found otherwise eligible.
We heard Shri Ajesh Luthra, learned counsel for the respondents and Shri Ravinder Aggarwal, learned counsel for the respondents.
The necessity for us to deal with the issue in detail, is obviated on account of the fact that OA No. 4497/2014, in which similar issue was raised, was dismissed by this Tribunal on 30.08.2016. It is also brought to our notice that in Writ Petition No.11603/2016, the Hon'ble High Court of Delhi has upheld the order passed in that OA.
Therefore, the OA is dismissed.
Pending MA, if any, also stands disposed of.
There shall be no order as to costs.
