Judgment
The instant Criminal Revision Petition has been filed by the petitioner, namely, Nazir Ali seeking quashment of the Orders dated 27.01.2017 and 29.01.2016 whereby the amount of maintenance has been enhanced by the learned District & Sessions Judge, Samba from Rs. 6000/- to Rs. 16000/- allegedly against the provisions of law.
After arguing for a while, learned counsel for the respondents, submits that the instant petition can be disposed of at this stage thereby directing the petitioner who is husband of respondent No. 1-Rashma Bibi and father of respondents 2 to 4 to pay Rs. 12,000/- per month as final maintenance. To this, proposal also other side has no objection. Their statements are taken on record.
In view of the above, this Criminal Revision Petition is disposed of with the direction that the petitioner shall pay Rs. 12,000/- per month as final maintenance to the respondents, i.e., his wife respondent No. 1-Rashma Bibi, respondent No. 2-son and respondents 3and 4 his daughters.
The respondents are however, at liberty to file an application for enhancement of maintenance on account of change of circumstance in future, if any.
