Judgment
This Miscellaneous Application has been registered on the basis of the joint inspection report submitted by the HSPCB dated 06.10.2023.
In the Original Application, the grievance relating to discharge of toxic chemical by Bhagwati Technology Private Limited, Dudhaula Road, Dhateer, District Palwal, Haryana was raised with the plea that the same was adversely affecting agricultural land in the vicinity. The Tribunal had disposed of the OA with the direction that District Magistrate, Palwal and the State PCB in coordination with concerned officials including District Agricultural Officer will look into the matter and take appropriate remedial action and submit report before the Tribunal.
The report, so filed, before the Tribunal reveals that the industry in question is a ‘red’ category industry and that the treated water from ETP is discharged for irrigation (‘unit has their own agricultural land adjoining the company’).
Learned Counsel appearing for the UPPCB on instructions has informed that the unit has half acre of land inside the premises and two acres of land outside and that as per consent to operate 8 KLD of treated effluent water is being discharged by the unit. The available land of the unit may not be sufficient to utilize the entire discharged treated water. That apart, the report also states that the unit is in the process of setting up the STP. Learned Counsel for the HSPCB has informed on instructions from the Regional Officer that the STP is at the commissioning stage.
In the circumstances, the concerned officer are required to explore the possibility of having a Tertiary Treatment Plant so that the treated discharge is utilized by the unit itself. Hence further report keeping in view the observation made above be filed before the Registrar General of the Tribunal within three months by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in the form of Image PDF and if found necessary, the matter may be listed for consideration before the Bench.
MA is accordingly disposed of.
