Apprehending arrest in Crime No.890/2023 of Peringome Police Station, Kannur District, registered for offences punishable under sections 294(b), 324, 384, 427 and 448 read with Section 34 of the Indian Penal Code, the petitioner/ 2nd accused has filed this petition seeking pre-arrest bail.
The prosecution case is that on 08.08.2023 at 4 pm, the accused trespassed to the courtyard of the house of the de facto complainant at Thandanattu Poyil, Perinthatta, and uttered obscene words against her husband, committed mischief by destroying the mobile phone and also committed theft of a scooter, which was in the courtyard of the house. Thereby the accused have committed the above offences.
The learned counsel appearing for the petitioner and the learned Public Prosecutor were heard.
This is the second bail application filed by the petitioner seeking anticipatory bail. I do not find any change in circumstances to entertain this bail application. That apart, in the earlier application, anticipatory bail was refused to the petitioner herein,interalia on the ground of several antecedents reported against the petitioner. In such circumstances, I do not find any change in circumstances to take a different view this time. Accordingly, the anticipatory bail application will stand dismissed.
