Heard Sri P.Giri Krishna, learned counsel appearing on behalf of the petitioners and Sri G.Nagaraju, learned Assistant Government Pleader for Civil Supplies appearing on behalf of the respondent Nos.1, 3, 5, 6 & 7, learned Standing counsel for Telangana State Civil Supplies Corporation Limited appearing on behalf of respondent Nos.2 & 4, Sri D.Srinivas, learned counsel appearing on behalf of respondent No.9 and Sri Laxmikanth Reddy, learned Assistant Government Pleader for Home appearing on behalf of respondent No.10.

The petitioners approached the Court seeking prayer as under:

"...to declare the action of respondent authorities in not considering the representations of the petitioners dated 29.07.2026 for granting 6 months time permitted the petitioners to deliver the balance stocks of rice to be delivered i.e., 8 ACK for the seasons 2023-24 and 26 ACKs for the seasons 2024-25 in regarding with the Petitioner No.1 to 3 rice mill. Consequently, direct the Respondent authorities to consider the representations dated 29.07.2026 permitting the petitioners to deliver the balance rice to be delivered by the petitioners' rice mill within a period of 6 months and to pass such other or orders..."

The case of the petitioners in brief as per the averments made in the affidavit filed by the petitioners in support of the present Writ Petition is as under:-

The writ petitioner Nos.1 to 3 is represented by the Proprietor by name Garipelli Prabhakar, who is engaged in the business of manufacturing and selling of rice, its allied products, co-products and by-products from the activity of milling of paddy. While so, the respondent authorities issued a Memo dated 24.11.2025, through which all the rice millers in Telangana State who are in due whatever the quantity from the seasons pertaining to KMS 2014-15 to KMS 2023-24 were given time of 90 days for delivering FRK Sannabiyyam and it was also informed that whoever delivers the balance stocks, respondent authorities would not take any action for recovery of said dues. Apart from that respondent Nos.4 and 5 have issued show cause notices dt.06.04.2026 and 16.05.2026 coercing the petitioner Nos.1 to 3 for severe action, without following due process of law. Pursuant to the said notice, petitioner Nos.1 to 3 had submitted representations on 29.07.2026 requesting to grant time for delivering the balance rice by way of FRK Sannabiyyam. But the respondent authorities, without considering the said representation of the petitioners are trying to take coercive steps against the petitioner. Challenging the action of the respondents in not considering the representation of the petitioners dt.29.07.2026, seeking extension of 6 months time to deliver the balance stocks of rice i.e, 8 ACKs for the season 2023-24 and 26 ACKs for the season, 2024-25, the present writ petition is filed.

PERUSED THE RECORD:-

DISCUSSION AND CONCLUSION:-

Learned counsel appearing on behalf of the petitioners, mainly puts-forth the following submissions:-

i)

The petitioners while submitting a detailed representation, dated 29.07.2026 to the official respondents herein, requested extension of six (06) months time period for the purpose of delivering balance stocks of rice i.e., 8 ACKs for the season 2023-24 and 26 ACKs for the season 2024-25 pertaining to the petitioner's rice mills.

ii) The said representation of the petitioners had been acknowledged by the official respondents on 29.07.2026 itself.

(iii)

The limited relief the petitioners seek in the present writ petition is consideration of petitioners' representation dated 29.07.2026 on humanitarian grounds, since the petitioner Nos.1 to 3 was unable to deliver the balance stocks, due to certain specific circumstances beyond its control explained in the representation dated 29.07.2026.

Based on the aforesaid submissions, learned counsel appearing on behalf of the petitioners submits that the petitioners are entitled for the relief as prayed for in the writ petition.

Learned Assistant Government Pleader for Civil Supplies mainly puts forth the following submissions:

(i)

Show cause notices dated 06.04.2026 vide No.F3/89/2024 had been issued by the District Collector calling upon the petitioners to explain as to why the petitioners' rice mill should not be blacklisted and as to why appropriate action should not be initiated as per the Telangana Rice (Custom Milling) Order, 2015 and as per terms and conditions of agreement entered by the petitioners with TSCSCL, since the petitioners failed to deliver entire CMR on or before 16.02.2026.

(ii)

The petitioners did not give any explanation to the show cause notice issued on 16.05.2026 calling upon the petitioners to explain as to why the criminal action should not be initiated against the petitioners’ rice mill and Recovery proceedings should not be initiated since the petitioners failed to deliver the due CMR in the form of FRK Sannabiyyam within the time stipulated as per the Memo No.1027/CS.I-CCS/2026 dated 28.04.2026.

(iii)

The petitioners’ request can be considered only by the 9th respondent herein.

Based on the aforesaid submissions the learned Assistant Government Pleader appearing on behalf of the respondents contends that appropriate orders may be passed.

In view of the fact that the petitioner did not submit any explanation in pursuance to the show cause notices dated 06.04.2026 and 16.05.2026 issued to him and in view of the detailed representation dated 29.07.2026 explaining the difficulties in delivering the balance stocks of rice i.e., 8 ACK for the seasons 2023-24 and 26 ACK for the seasons 2024-25 pertaining to the petitioners’ rice mill, and seeking extension of six months time period for delivering the same, which admittedly had not been considered by the respondents as on date, this Court opines that respondent authorities need to consider the same in accordance to law and pass appropriate orders within a reasonable period, in the interest of Justice.

7. TAKING INTO CONSIDERATION:

The aforesaid facts and circumstances of the case,

b)

The submissions made by the learned counsel appearing on behalf of the petitioners and learned Assistant Government Pleader for Civil Supplies appearing on behalf of the respondents.

c)

The contents of the show cause notices dated 06.04.2026 and 16.05.2026 issued to the petitioners,

d)

The contents of the petitioner's detailed representation, dated 29.07.2026 addressed to the official respondents.

e)

The discussion and conclusion as arrived at paragraph Nos. 4 to 6 of this order,

Without going into the merits of the case, upon consent of both the learned counsel on record, the writ petition is disposed of directing the 5th and 9th respondents to consider the grievance of the petitioners as put-forth vide petitioners' representation, dated 29.07.2026 addressed to the official respondents herein seeking extension of six months time period for the purpose of delivering balance stocks of rice i.e., 8 Acks for the season 2023-24 and 26 Acks for the season 2024-25 pertaining to the petitioner's rice Mills, to the respondent Authority, and duly communicate the decision on petitioners' representation, dated 29.07.2026 to the petitioners, within one week from the date of receipt of the copy of the order. Till the above exercise is concluded by passing of appropriate orders by the 5th and 9th respondent, duly considering petitioners representation dated 29.07.2026, in accordance to law, in conformity with principles of natural justice, by providing an opportunity of personal hearing to the petitioners as per the specific directions as issued above and within the time period as stipulated as above, the respondents are directed not to take any coercive steps against the petitioners pertaining to subject issue. However, there shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
