Natraj Proteins Ltd. vs Claro Energy Pvt. Ltd.

Application filed through IRP under Section12-A seeking withdrawal of CIRP process initiated against the Claro Energy Pvt. Ltd. vide order dated 13^th April 2021. Learned Senior Counsel Mr. Chaudhary for IRP states that in view of settlement arrived between Operational Creditor and Corporate Debtor and entire payment in terms of settlement being paid to the applicant, withdrawal is sought. Mr. Chaudhary further states that copy of consent of Operational Creditor in Form “FA” is annexed as well as the settlement letter issued by the applicant dated 30^th April 2021 is also annexed. It is submitted that CoC is not formed and no claim has been received by IRP. Mr. Chaudhary further states that the entire IRP cost has been paid. IRP Mr. Rajesh Lohiya present in person confirms the same. In view of the same, we allow the application and allow IB-2992/ND/2019 to be withdrawn as settled and the same stands disposed of. IRP is directed to hand over all documents, proceedings, assets and other belonging of the Corporate Debtor received by him to the Management of the Corporate Debtor within two days. Let, this order be served to ROC to update status of the Corporate Debtor from “under CIRP” to active”. The application is allowed and IB stands disposed of in terms of above order.
