Judgment
ORDER
In this Original Application (OA), the Applicant has alleged that illegal construction of Mining Inspection Post and weigh bridge is being carried out within 100-150 meters of rivers and the water bodies. He has further alleged illegal dumping of muck and debris. The plea of the applicant is that such activities result in frequent land slides causing threat to life and property.
Learned counsel for the Applicant was permitted by the order dated 16.04.2026 to file the additional material in support of the plea that the construction was being raised in violation of the environmental norms, rules, regulations and circular of the competent Authority. Thereafter, the applicant has filed only certain photographs along with IA No. 339/2026.
At this stage, submission of the counsel for the applicant is that a complaint was made to the District Magistrate, Sirmaur, Nahan, Himachal Pradesh pointing out the violations. But the said complaint has not been considered till now. A copy of the complaint has been placed on record on page 39 of the paper book.
Having regard to the circumstances of the case and the fact that the ground level verification is required to be done to ascertain if there is violation of any environmental norms, we dispose of the present OA directing the Respondent No.12-District Magistrate/Deputy Commissioner, Sirmaur to duly consider the complaint of the applicant and if any violation of the environmental norm is found take appropriate remedial and punitive action expeditiously. Let this exercise be completed within two months from the date of receipt of copy of this order.
The OA is accordingly disposed.
All the pending IAs also stand disposed of.
