Judgment
Mohammad Yaqoob Mir, J.—Delay of 134 days in preferring the Revision Petition against the order passed by the Court of Munsiff
(Judicial Magistrate), Baramulla, dated 18.05.2010, is sought to be condoned. Respondent despite service has not chosen to appear. In the
application it is stated that due to turmoil in the Valley, for a considerable period lawyers could not appear, when it came to a little halt, the
petitioner (defendant in the suit) from his counsel came to know that the suit has been dismissed in default. The counter claim set up by the
petitioner (defendant) was required to be proceeded with, same has not been done which necessitated the filing of revision petition.
The ground projected for condoning the delay has remained to be controverted as the respondent has not chosen to appear. It being so, the
delay is condoned. Revision petition taken on board. COD, accordingly, disposed of.

Summon be issued for securing presence of the respondent. Same be sent for execution through District Judge, Baramulla.
