Counter affidavit filed by the respondents are taken on record.

Petitioner claiming to be Chairman of the Education Council, Block Rosera, District- Samastipur has filed this writ petition in public interest and the

grievance is that inspite of memos issued on 04.01.2011, 07.06.2013 and 22.09.2016 the authorities of the District in question are indulging in deputing

teachers of Primary Schools for non- teaching work, which is prohibited by the State Government.

Counter affidavits have been filed by Respondent Nos. 4, 6 and the State Government and Madam Shilpa Singh, G.A. 12 invites our attention to the

averments made in the said counter affidavit and points out that apart from the fact that teachers of the Primary Schools are not being deputed to do

non-teaching work after filing of the writ petition, to clarify the position again, letters have been issued in this regard, as is evident from the pleadings

made in Paragraphs 5 and 6 of the counter affidavit filed by Respondent No. 4 along with Annexure-R4B.

Taking note of the aforesaid, we are satisfied that the State Government and the authorities concerned have taken steps for preventing the deputation

of Primary Schools Teachers for the non-teaching purposes and no further directions are issued in the matter. However, now in case any specific

instances are pointed out by the petitioner, the Principal Secretary, Education Department Respondent No. 2 and the Principal Secretary, General

Administration Department, Respondent No. 3 may look into the grievance of the petitioner.

With the aforesaid liberty to the petitioner, finding no further indulgence to be made into the matter, the writ petition stands disposed of.
