Anoop Chitkara, J
Mr. Mandeep Chandel, learned Advocate, submits that the petitioner had joined the investigation.
The facts necessary to decide this petition are that the petitioner used the caste based derogatory words, which are prohibited under the Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the complainant in the temple premises. Consequently, FIR No.65/2020, dated 1. 3.2020, under Sections 3(1) and 3(2) of the Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989 HP, came to be registered against the petitioner.
Mr. Nand Lal Thakur, learned Additional Advocate General, does not dispute the fact of the petitioner joining investigation.
Given the nature of allegation and the fact that the petitioner had joined investigation, interim order dated 4.3.2020, is made absolute, on the same terms and conditions. It is, however clarified that in case the petitioner browbeats, repeats the offence or in any manner treats the complainant as unequal, then the State as well as the complainant can file application for cancellation of this bail.
Accordingly, the present petition stands disposed of.
