Judgment

Mr. Ram Murti Bisht, learned Advocate, submits that the petitioner had joined the investigation.
The facts necessary to decide this petition are that during congregation for paying obeisance to local deity, the petitioner used the caste based derogatory words, which are prohibited under the Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989 and had also interfered while people of all castes were offering prayers to the deity. Consequently, FIR No.28/2020, dated 27.6.2020, under Sections 3(1)(S), 3(1)(za)(c) of the Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989 HP, came to be registered against the petitioner.
On the previous date of hearing, the accused had appeared in person in the regular Court.
Mr. Nand Lal Thakur, learned Additional Advocate General, has filed status report through e-mail and copy of the same has been taken on record. Learned counsel for the petitioner has also received copy of the status report. Learned Additional Advocate General does not dispute the fact of petitioner joining the investigation.
Given the fact that the petitioner had joined investigation, interim order dated 1.7.2020, is made absolute, on the same terms and conditions. It is, however clarified that in case the petitioners browbeats, repeats the offence or in any manner treats the complainant as unequal, then the State as well as the complainant can file application for cancellation of this bail.
Accordingly, the present petition stands disposed of.
