Narender Kaur vs State of Haryana and Others

M.M. Kumar, J.—The instant petition is directed against the transfer order dated 22.8.2006 (P-6) on the principal ground that she is scout

trained teacher and as per the policy a scout trained teacher could be transferred only to a school where scout training is being imparted. It is

further asserted that such teacher could be replaced by a scout trained teacher only. As the petitioner has been transferred to a place where scout

training is not given and the teacher who has been transferred replacing her is also not a scout trained teacher, the order of transfer dated

22.8.2006 (P-6) is asserted to be illegal.

Having perused the averments made by the petitioner, we deem it just and proper to direct the petitioner to file a representation to respondent

No. 2 pointing out the aforementioned violation of the policy. If any such representation is made within a period of three weeks from today the

same shall be decided expeditiously by respondent No. 2 preferably within a period of four weeks from the date of its receipt by passing a

speaking order.

The writ petition stands disposed of in the above terms.
