Learned counsel for the petitioner submits that the petitioner, who is a PGT (Biology), has been transferred from Government School Mantindu, Sonipat to Government High School Budhakhera, Hisar, which is at a distance of about 170 kms. The place of the current posting of the petitioner is in Zone-5 and as per the terms of the policy, there is no limit to the number of years an employee can remain posted in Zone-5. The petitioner is the only Biology Teacher in the school and the Principal of the School had also written against her transfer. A copy of the communication is at Annexure P-16. He further submits that the petitioner has not been relieved. He further contends that the petitioner had sent a representation (Annexure P-10) in this regard and would be satisfied if this petition is disposed of with a direction to respondent No.2 to consider and decide the representation (Annexures P-10) in terms of the policy.
Issue notice to respondents.
At the asking of the Court, Mr. Anant Kataria, DAG, Haryana accepts notice on behalf of respondents.
Without expressing any opinion on the merits of the case, the petition is disposed of with a direction to respondent No.2 to consider and decide the representation (Annexures P-10) in terms of the policy within a period of 10 days from the date of receipt of certified copy of this order.
Till the representation is decided, the petitioner would not be relieved.
