Judgment
M. Sundar, CJ
[1] This order has to be read in conjunction with and in continuation of proceedings made in the listing yesterday (25.09.2025), which reads as follows:
“After arguments, Mr. T. Rajendra, learned senior counsel for petitioner submits that it would be desirable to have the matter listed tomorrow i.e., 26.09.2025 so as to enable his instructing counsel to get further instruction from his client.
List on 26.09.2025.”
[2] Today, Mr. Md. Shakir Khan, learned counsel on record for the CRP petitioner, sought leave of this Court to withdraw the captioned CRP and the captioned Misc. Case thereat, but made a request to preserve all rights and contentions of the revision petitioner to pursue his case in the Suit in the Trial Court, namely, Original Suit No. 14 of 2020 on the file of the Court of Civil Judge Senior Division, Thoubal, Manipur (Trial Court, for convenience).
[3] Learned counsel has made an endorsement in this regard in the case file. Scanned reproduction of the endorsement is as follows:
[4] In the light of the narrative thus far, captioned CRP and captioned Misc. Case thereat are disposed of as withdrawn/closed, albeit with preservation of rights and contentions of revision petitioner in the aforesaid manner.
[5] Though obvious, it is made clear that withdrawal of captioned CRP shall not impact the proceedings before the Trial Court. To put it differently, the Trial Court shall proceed with the Suit and any interlocutory application thereat (pending or to be filed) on its own merits and in accordance with law, untrammeled by withdrawal of the captioned CRP.
[6] For the sake of specificity, it is also made clear that this Court has not expressed any view or opinion on the merits of the matter.
[7] Captioned CRP and Misc. Case are disposed of as withdrawn/closed albeit with preservation of rights and contentions (including points raised in the captioned CRP) in the aforesaid manner. There shall be no order as to costs.
