This revision, filed under Section 115 C.P.C, arises out of the order dated 28.11.2019 passed by the learned Civil Judge (Junior Division), Imphal East, in Judl. Misc. Case No. 209 of 2019 (Ref: O.S. No. 36 of 2019). Notice was ordered to the respondent herein on 26.02.2020 and the order under revision was stayed till the next date. Thereupon, Mr. Th. Mahira, learned counsel, entered appearance for the respondent.
There was no representation for the petitioners or their learned counsel on 10.11.2022 and again on 14.12.2022. Mr. Th. Mahira, learned counsel, stated on 14.12.2022 that this revision was infructuous as the very suit from which it arose was dismissed as withdrawn. The matter was accordingly directed to be listed under the caption ‘Dismissal’ on 21.12.2022.
Today, though the matter appears under the caption ‘Dismissal’, there is no representation for the petitioners or their learned counsel.
In the light of the statement made on the earlier occasion by Mr. Th. Mahira, learned counsel, the failure of the petitioners and their learned counsel in attending to this case seems to be for obvious reasons.
CRP No. 2 of 2020 is accordingly dismissed for non-prosecution.
In consequence, interim order dated 26.02.2020 shall stand vacated.
