None appears on behalf of the petitioner today. However, Learned Counsel for the respondent- State is present. Learned Counsel for the

respondent- Stated submitted on the basis of the counter affidavit filed on their behalf that petitioner has claimed compensation in respect of 3 plots

of land bearing No. 5734, 5735 and 5733 situated at Gumo, Koderma in connection with land acquisition proceeding. However, it is submitted on

behalf of the counsel for the respondent by referring to the statement made in para 6 of the counter affidavit that in respect of plot No. 5734 the

petitioner had not submitted any revenue records as would appear from the application filed on behalf of the petitioner contained in annexure C, D,

and E. In respect of plot No. 5735 it has been stated in the said paragraph itself that the vendor of the said plot Rito Mahto was awarded

compensation amount, which was deposited in Hazribag Treasury on 16.6.1972. Father of the petitioner has acquired the said land from the

original awardee. In respect of the 3rd piece of land i.e. plot No. 5733, it has been stated in the counter affidavit that the said plot belongs of khata

No. 220/506, which is G.M. Khas land for which petitioner during the proceeding of L.A. Case No. 01 of 1999-2000 could not produce any

alleged sale deed and failed to prove the rightful ownership of the land by furnishing rent receipt issued by the Karmachari and Municipal Tax,

which are substantial proof for deciding the ownership of the petitioner.

Rejoinder to the said counter affidavit has been filed. However, in order to give one more opportunity, list this case after one week.
