Judgment
With the consent of both parties, this Writ Petition is taken up for disposal at the stage of admission.
This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
"...to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents more particularly Respondent No.3 in entertaining the document despite Ad-interim injunction granted by the learned III Additional Junior Civil Judge, Khammam, in I.A. No.2 of 2025 in O.S. No.109 of 2025 and representation of the petitioner dt.13.08.2026, in respect of agricultural land bearing Survey No.161/A3, admeasuring Ac. 0.3150 guntas, situated at Gubbagurthy Revenue Village, Konijerla Mandal, Khammam District in favour of Respondent No.5 as wholly illegal, arbitrary, contrary to law and consequently direct Respondent No.3 not to entertain and register the document by duly consider the representation of the petitioner dt. 13.08.2026 in favour of Respondent No.5 or any third party in respect of agricultural land bearing Survey No.161/A3, admeasuring Ac. 0.3150 guntas, situated at Gubbagurthy Revenue Village, Konijerla Mandal, Khammam District and to pass..."
Heard Mr. Narsi Reddy Pesara, learned counsel for the petitioner and learned Assistant Government Pleader for Stamps and Registration, appearing for the respondents.
Learned counsel for the petitioner submits that the petitioner entered into an Agreement of Sale dated 24.06.2023 with respondent No.4 for purchase of agricultural land bearing Sy.No.161/E, admeasuring Ac.1.17 guntas, situated at Gubbagurthy Revenue Village, Konijerla Mandal, Khammam District. Pursuant to the said agreement, the petitioner paid a sum of Rs.5,00,000/- towards part of the sale consideration, with the balance amount of Rs.1,27,000/- agreed to be paid at the time of registration of the sale deed. However, despite having received a substantial portion of the sale consideration, respondent No.4 failed to perform his part of the contract. Therefore, the petitioner was constrained to institute O.S. No.109 of 2025 before the learned III Additional Junior Civil Judge, Khammam. In the said suit, the petitioner filed I.A. No.2 of 2025, wherein the learned trial Court, by an order dated 28.02.2025, granted an ad-interim injunction restraining respondent No.4 from alienating the schedule property till 20.03.2025. The said interim order was thereafter extended from time to time and continues to remain in force as on date. Learned counsel further submits that, notwithstanding the subsisting order of injunction passed by the competent civil Court, respondent No.3 proceeded to entertain sale transactions in respect of the subject property. As such, the petitioner submitted a representation dated 13.08.2026 to respondent No.3 requesting the respondent authorities not to entertain or process any sale transactions in respect of the subject property, in view of the subsisting order of injunction dated 28.02.2025 passed in I.A. No.2 of 2025 in O.S. No.109 of 2025. However, no action has been taken by respondent authorities so far. Therefore, learned counsel prays this Court to direct respondent No.3 to consider the petitioner's representation dated 13.08.2026 and pass appropriate orders, within a time-frame stipulated by this Court.
Learned Assistant Government Pleader appearing on behalf of the respondents fairly submits that respondent No.3 will consider the petitioner's representation dated 13.08.2026 and pass appropriate orders, in accordance with law.
Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of directing respondent No.3 to consider the petitioner's representation dated 13.08.2026 in the light of injunction order dated 28.02.2025 passed by the learned trial Court in I.A. No.2 of 2025 in O.S. No.109 of 2025 and pass appropriate orders thereon, strictly in accordance with law, as expeditiously as possible, preferably within a period of two (2) weeks from the date of receipt of a copy of this order and communicate a copy of the decision to the petitioner.
Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
