Judgment

The petitioner herein is arraigned as accused No.2 in Crime No.174 of 2023 of Bhimadole Police Station for the offence under Sections 120(B), 419, 420, 467, 472, 474 r/w 34 IPC and Section 66 (C) & (D) of I.T. Act.
It is alleged in the complaint that the petitioner in connivance with accused No.1 has collected money from unemployed persons by promising jobs in ISRO. It is also alleged in the complaint that the de facto complainant has transferred money to various accounts as instructed by accused No.1.
It is stated in the remand report that the petitioner/accused No.2 herein also collected money from the accused No.1.
The learned counsel for the petitioner/accused No.2 submits that the FIR was registered on 25.07.2023 and that the petitioner is an Advocate and had rendered professional advice to the accused No.1.
The learned Assistant Public Prosecutor submits that the investigation is pending and that other accused are to be arrested.
The learned counsel for the petitioner also furnished copies of the bank statements. The statements furnished by the petitioner also show that the payments were received by the petitioner, however, it is submitted that, the payments were made towards the professional services rendered by the petitioner.
Be that as it may, the petition deserves consideration for the reason that the police have been completely inactive since July 2023 after registering the FIR.
Considering the same, this Court is inclined to grant bail with the following conditions:-
i.The petitioner/Accused No.2 shall be enlarged on bail in the event of arrest on he executing a personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of the Bhimadole Police Station.
ii. The petitioner/Accused No.2 shall appear before the Station House Officer Bhimadole Police Station on every Monday between 10:00 am to 12:00 Noon until filing the charge sheet/final report.
With the above conditions, the criminal petition is allowed.
Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
