Judgment
This Writ Petition is filed to declare action of respondent Nos.1 and 2 in not approving the enhanced seats in B.Tech, Computer Science and Engineering (Artificial Intelligence & Machine Learning) course from the existing 120 seats to 180 seats for the Academic Year 2022-23 and not including the same in the web options of the EAMCET-2022 Counseling commenced from 21.08.2022 despite the approval by the All India Council for Technical Education (AICTE), New Delhi vide its Extension of Approval (EoA) bearing F.No.South-Central-1097584315/2022/EOA, dated 03.07.2022 and declare the same as illegal, and consequently direct respondent Nos.1 and 2 to pass appropriate orders on the above said approval by the AICTE, New Delhi and further direct 3rd respondent to include the enhanced seats in B.Tech, Computer Science and Engineering (Artificial Intelligence and Machine Learning) course from the existing 120 seats to 180 seats for the Academic Year 2022-2023 in 2nd petitioner’s College in the EAMCET 2022 counseling commenced from 21.08.2022.
Heard Sri S.Satyam Reddy, learned Senior Counsel representing Ms. K.V.Rajasree, learned counsel for the petitioners and Sri M.Parma Reddy, learned Assistant Government Pleader for Education appearing for the respondents. Perused the record.
Perusal of the record would reveal that vide proceedings dated 03.07.2022, AICTE, has extended approval for the Academic Year 2022-23. A copy of the same was also marked to 1st respondent as well as 3rd respondent. Even then, 1st respondent has not considered the same.
Sri M.Parma Reddy, learned Asst.Govt.Pleader for Education would submit that 1st respondent has not received the said proceedings dated 03.07.2022 of AICTE and if the petitioners submit any representation along with the copy of the said proceedings, dated 03.07.2022, 1st respondent will consider the same and take a decision on the same in accordance with law.
In view of the aforesaid submission, this writ petition is disposed of granting liberty to the petitioners herein to submit representation by 10.09.2022 to the 1st respondent by duly enclosing a copy of the proceedings dated 03.07.2022 of AICTE with specific request to accord approval for enhancement of seats. On receipt of the said representation, 1st respondent shall consider and dispose of the same in accordance with law within one week thereafter.
Miscellaneous Petitions, if any, pending, shall also stand closed.
