Heard learned counsel for the petitioners and learned counsel for the State. The petitioners are accused in a case registered under Sections 147/148/149/323/324/325/326/307 I.P.C. and u/s 27 of the Arms Act.

Counsel for the petitioners has submitted that actually dispute arose regarding drainage of the field which leads to an altercation and ultimately to the assault to which both the parties have received some injuries but, thereafter, both the parties have compromised the matter outside the Court. Photostat copy of the certified of the joint compromise petition has been annexed in this application as Annexure-2. Considering the fact that both the parties have compromised the dispute outside the Court and considering this y aspect, only for granting bail, I direct all the petitioners, namely, Nakul Yadav, Kanti Yadav, Ghana Yadav @ Jhaman Yadav, Prakash Yadav, Bhim Prasad Yadav @ Bhim Yadav, Jaldhar Yadav, Ramchandar Bhagal @ Ramchandar Yadav, Gugli Yadav @ Gugliya Yadav, Gopal Yadav, Lal Bihari Yadav, Bechan Yadav @ Bechdev Yadav, Badri Yadav, Bitu Yadav, Rajendra Yadav, Brahmdev Yadav @ Ramdev Yadav, Bilo Yadav, Ganeshi Yadav @ Ganesh Yadav, Maisi Yadav @ Manesh Yadav, Ayodhya Prasad Yadav, Bond Yadav @ Bonga Yadav, Sahdev Yadav, Bikash Yadav, Bhawesh Yadav and Puni Yadav to surrender in the court below/trial court within a period of one month from the date of this order i.e. 01.09.2012. If they surrender within the said period, the trial Court/court below is directed to release them on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of like amount each to the satisfaction of Judicial Magistrate, Ist Class, Godda in connection with Pathargama (Basantray) P.S. Case No. 179/2011 corresponding to G.R. No. 1410/2011, subject to the condition that both the bailors will be local resident having immovable property within the jurisdiction of the trial court and subject to the conditions laid down u/s 438(2) of the Cr.P.C.
