Judgment
Rajesh H. Shukla, J.—Present Appeal from Order has been filed by the appellant-original plaintiff being aggrieved with the order passed below notice of motion, Exh. 6-7 by the Aux. Chamber Judge, Court No. 14, City Civil & Sessions Court dated 27.02.2012 on the grounds stated in the memo of Appeal from Order. Heard learned counsel, Shri Virat Salot for the appellant and learned Sr. Counsel, Shri Y.N. Oza appearing with learned counsel, Shri B.R. Parikh for the respondent nos. 1 and 2.
After arguing for some time, learned counsel, Shri Salot for the appellant does not press this Appeal from Order without prejudice to the rights and contentions and with a request that suit may be directed to be expedited.
In the facts and circumstances, Civil Suit (CCC) No. 1891 of 2011 pending before the City Civil Court at Ahmedabad is ordered to be expedited. The concerned Judge of City Civil Court shall make an endeavour to dispose of the said suit as expeditiously as possible preferably within six months in accordance with law after giving opportunity to all concerned.
In view of above, present Appeal from Order stands dismissed as not pressed. It goes without saying that the present Appeal from Order is disposed of without expressing any opinion and suit may be considered on merits without being influenced by the present order for disposal of Appeal from Order. In view of dismissal of main Appeal from Order, both above Civil Applications stand disposed of accordingly. Notice is discharged. Ad-interim relief stands vacated.
