Petitioner Nagina Devi had filed an application under section 125 Cr. P.C before the Principal Judge, Family Court, Palamau at Daltonganj vide Misc. Case No. 14/2004. Learned Principal Judge, Family Court, Palamau at Daltonganj vide order dated 18.08.2009, allowed the application of the petitioner and directed the opposite party no. 2 Suresh Ram to pay maintenance to the petitioner @ Rs. 1,000/- per month.
Being aggrieved by the quantum of maintenance awarded by the learned court below, petitioner has preferred this revision application.
Mr. Faruque Ansari, learned counsel appearing on behalf of the petitioner, seeks permission to withdraw this revision application with liberty to file an application under section 127 Cr. P.C before the learned Principal Judge, Family Court, Palamau at Daltonganj for enhancement of maintenance amount.
Prayer is allowed.
Petitioner, if so advised, may file an application before the learned Principal Judge, Family Court, Palamau at Daltonganj under section 127 Cr. P.C., who shall dispose of her application as expeditiously as possible without giving unnecessary adjournment to either of the parties.
