Judgment
S.B. Sinha, C.J.—In this writ petition, the petitioner prays for issuance of a writ, order or direction, more particularly one in the nature of writ of certiorari. quash the proceedings in Lr. No. ADE/O/GPT/D. No. 433/2000 dated 23-6-2000. issued by respondent No. 2 in terms of the directions of respondent No. 3 vide proceedings Lr. No. 277/PC B/ROU/TECH/97-7 dated 3-4-2000., and consequently restore power supply to the petitioner-unit.
The only ground raised by the learned Counsel for the petitioner in the support of the writ petition is that the name of the unit/ industry run by the petitioner is M/s. Nagalakshmi Blue Stone Industry, and though closure orders have been passed by respondent No. 3 in the name of M/s. Nagalaxmi Black Stone Crusher, respondent Nos. 1 and 2 disconnected power supply to the petitioner-unit.
On closer scrutiny of the material on record, it appears that the service connection of the petitioner is 210, This is evident from the cause title of the writ petition also. By reason of the impugned order, 23-6-2000, power supply to S.C. No. 210 was disconnected.
Mr. Bhatt. the learned Counsel appearing on behalf of respondent No. 3-A.P. Pollution Control Board submits that the petitioner without obtaining any consent from respondent No. 3. as required u/s 31 of the Air (Prevention & Control o Pollution) Act, 1981, is running the unit and as such closure orders were passed.
Having regard to the fact that the service connection of M/s. Nagalakshmi Blue Stone Industry and M/s. Nagalaxmi Black Stone Crushing being one and the same, we are of the opinion that respondent Nos. 1 and 2 were justified in disconnection power supply to the petitioner pursuant to the orders of respondent No. 3.
For the reasons aforementioned, we find no merit in the writ petition, and it is accordingly dismissed. No costs.
