Applicant- Nabeen Singh, who is in jail in connection with Crime No. 06 of 2012, relating to offences punishable u/s 354, 366, 376/511 and 506 of I.P.C., Police Station Kotwali Bageshwar, District Bageshwar, has sought his release on bail.

Learned counsel for the applicant pleaded that it is a case of molestation of a girl, who appears to have taken lift in the truck which was being driven by the applicant. It is further submitted that there is no allegation of rape or attempt to commit rape by the present applicant in the First Information Report. It is argued that had the girl been thrown from the running truck, she would have suffered the injuries. It is probable that she might have got down after she requested for the same.

In the facts and circumstances of the case, without expressing any opinion as to final merits of the case, this Court is of the view that the applicant deserves bail. The Bail Application is allowed. Let the applicant-Nabeen Singh be released on bail on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of Chief Judicial Magistrate, Bageshwar.
