This Criminal Petition under Section 482 of B.N.S.S., is filed by the petitioner herein/A1 seeking to grant anticipatory bail in Crime No.91/2024 of Tirumala I Town Police Station, Tirupathi District registered for the offences punishable under Sections 318(4), 336(3), 340(2) read with 3(5) of the BNS.
Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor for the State.
Perused the record. On 16.12.2024, a case in Crime No. 91/2024 of Tirumala I Town Police Station, Tirupathi District was registered for the offences punishable under Sections 318(4), 336(3), 340(2) read with 3(5) of the BNS. Having heard both sides, it is seen that all the offences are punishable with imprisonment of seven years and less than seven years. It is, in these circumstances, investigating Police are directed to comply with Section 35(3) of BNSS scrupulously and all the directions given by the Hon’ble Supreme Court in the judgment in Arnesh Kumar Vs. State Of Bihar And Another (2014) 8 SCC 273 and other related rulings.
With these observations, the Criminal Petition is disposed of.
Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
