The Criminal Petition has been filed under Sections 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the petitioners/Accused Nos.2, 4 and 5 in the event of their arrest in connection with Crime No.275 of 2025 of Chilakaluripet Town Police Station, for the offences punishable under Sections 132 r/w 3(5) of B.N.S.
Case of the prosecution is that on 05.09.2025, when defacto complainant along with other police personal are on bandobust duty in view of Ganesh Idol Immersion in Chilakaluripeta Town limits, Accused Nos.1 to 5 obstructed the defacto complainant, abused him in filthy language and pushed him down and assaulted him.
Learned counsel for the petitioner contends that the petitioners will surrender before the Court below and upon such surrender, the Court may take appropriate steps as per law.
Learned Assistant Public Prosecutor has not objected for the same.
Accordingly, the Criminal Petition is disposed of granting liberty to the petitioners/Accused Nos.2, 4 and 5 to surrender before the concerned jurisdictional Magistrate within a period of one (1) week from the date of this order and move appropriate application. The concerned jurisdictional Magistrate is directed to dispose of the bail application filed by the petitioners/Accused Nos.2, 4 and 5 within a period of two (2) days on its own merits in accordance with law by giving due opportunity to the learned Assistant Public Prosecutor concerned.
