Mr. Javed Iqbal, Sub Inspector Incharge Prosecution, DPO Sopore present through virtual mode from his office along with Mr. Raman Sharma, AAG
Mr. Raman Sharma, learned AAG informs this Court that the applicant stands arrested and on the contrary, Mr. Gulzar Ahmed Sopori learned counsel for the applicant submits that the applicant on his own surrendered before the concerned police.
Be that as it may, the fact remains that the applicant is in custody. At this stage, learned counsel for the applicant submits that he may be permitted to withdraw this application with liberty to approach the trial court afresh.
Application is permitted to be withdrawn.
Senior Superintendent of Police, Sopore shall hand over the custody of the applicant to the Superintendent of Sub Jail, Hira Nagar, who shall produce him before the concerned court with which challan is pending for seeking appropriate orders with regard to the custody of the applicant.
Disposed of as above.
Copy of the order be forwarded to Senior Superintendent of Police, Sopore as well as Superintendent of Sub Jail, Hira Nagar.
