These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Kendrapara Sadar PS Case No.511 of 2025 corresponding to GR Case No.2183 of 2025 pending in the Court of learned SDJM, Kendrapara for commission of offence punishable U/Ss.331(4)/310(2) of BNS, on the main allegation of committing dacoity by trespassing into the house of the informant and taking away gold ornaments, cash and other valuables.
Heard, Ms. Rebatilata Panda, learned counsel for the petitioner in BLAPL No.3053 of 2026; Mr. Deepak Ku Sahoo, learned counsel for the petitioner in BLAPL No.6832 of 2026 and Mr. P. Satpathy, learned Addl. PP in these two matters and perused the record.
Admittedly, the petitioner- Mutura @ Umesh Ch. Sahoo is allegedly implicated in 27 criminal cases, but the petitioner has not disclosed his criminal antecedents in his bail application, however, today learned counsel for the petitioner has producecd a comprehensive affidavit for the petitioner indicating therein about registration of 26 criminal cases against the petitioner-Mutura @ Umesh Ch. Sahoo which is one short of the real figure. Further, it is found that the FIR has been registered against ten unknown persons, but it is claimed that no TI parade has been conducted to identify the suspect, however, the State counsel brings it to the notice of the Court that the petitioner Mutura @ Umesh Ch. Sahoo allegedly been identified in CCTV footage and on his confession, the other petitioner Jasobanta @ Jasowath Behera @ Dipu @ Pinku has been implicated in this case. In view of the aforesaid facts and circumstances and taking into consideration the mode and manner of implication of each of the petitioners and keeping in view the other circumstances on record in entirety including the criminal proclivity of the petitioner Mutura @ Umesh Ch. Sahoo, this Court while not being inclined to grant bail to the petitioner Mutura @ Umesh Ch. Sahoo considers it proper to admit the petitioner Jasobanta @ Jasowath Behera @ Dipu @ Pinku to bail.
Hence, the bail application of the petitioner Mutura @ Umesh Ch. Sahoo in BLAPL No.3053 of 2026 stands rejected, whereas the bail application of the petitioner Jasobanta @ Jasowath Behera @ Dipu @ Pinku in BLAPL No.6832 of 2026 stands allowed and the petitioner Jasobanta @ Jasowath Behera @ Dipu @ Pinku is accordingly allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:-
the petitioner- Jasobanta @ Jasowath Behera @ Dipu @ Pinku shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday in each month in between 10 A.M. to 12 Noon for six (06) months from the actual date of release from the custody.
The I.I.C. of Jurisdictional Police Station shall not detain the petitioner unnecessarily after recording their attendance beyond the time as stipulated.
Accordingly, these BLAPLs stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this judgment be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
