Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Korei PS Case No.190 of 2026 corresponding to CT Case No.838 of 2026 pending in the file of learned JMFC, Jajpur Road, Dist-Jajpur for commission of offences punishable U/Ss.310 (2)/111(2) of BNS, on the main allegation of committing organized crime and dacoity by taking away the Truck of the informant.
Heard, Mr. Arijeet Mishra, learned counsel for the petitioners and Mr. R.B. Mishra, learned Additional Public Prosecutor in the matter and perused the record.
After having considered the rival submissions and taking into account the nature and gravity of the offences as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the pretrial detention of the Petitioners in custody since 15.05.2026 with substantial progress in investigation and keeping in view the other circumstances on record in entirety including inherent right of the accused to be presumed innocent until proven guilty at the trial and the recovery of the stolen truck, this Court without expressing any view on merits admits each of the petitioners to bail.
Hence, these two bail applications of the petitioners namely Raghunath Dash, Dinesh Dash, Kalpataru Rout @ Kanha (In BLAPL No.6006 of 2026) and Subhakanta Nanda @ Likun (In BLAPL No.6007 of 2026) stand allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:-
the petitioners shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday in each month in between 10 A.M. to 12 Noon for six (06) months from the actual date of release from the custody.
The I.I.C. of Jurisdictional Police Station shall not detain the petitioners unnecessarily after recording their attendance beyond the time as stipulated.
Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
