By filing this writ petition, the petitioner has prayed for the following reliefs:-

"for grant of an appropriate writ in the nature of mandamus, or an order or direction, commanding upon the respondent nos.2 to 4 to take appropriate steps against respondent no.6 for encroachment of government land, as well as the land of the petitioner appertaining to Plot No.434 under Khata No.90 in Mouza - Marhand, by initiating a proceeding under the statutory law within a reasonable period, and for any other appropriate writ or order or direction as this Hon'ble Court may deem fit and proper."

Heard learned counsel representing the petitioner and learned counsel representing the respondents.

The petitioner in this writ petition seeks initiation of appropriate proceeding upon respondent No.6 for having encroached upon the Government land as well as the land of the petitioner.

So far as the Government land is concerned, there is a specific law to remove the encroachment. The Jharkhand Public Land Encroachment Act, is the law which governs the field and by invoking Section 3 of the said Act, an encroacher can be noticed and proceeding can be initiated. Further, as per Section 3, any person can approach the Collector, by filing an application, if a Government land is encroached.

So far as the land belonging to the petitioner, which is alleged to have been encroached upon by the private respondent, is concerned, the petitioner can approach the appropriate Civil Court for eviction of the private respondent i.e. respondent No.6.

With the aforesaid observations, this Writ Petition stands disposed of.
