The present MA has been filed by the applicants seeking permission to file the present OA jointly. For the reasons given in the MA and keeping in

view no objection from the learned counsel appearing for the respondents, the MA is allowed.

OA No.1735/2020

Applicant No.2 is an employee of the respondents and applicant No.1 is his son. The applicants have approached this Tribunal against the inaction

of the respondents vide which the respondents have not considered and finalised the request of the applicant No.2 for his voluntary retirement and

appointment of the applicant No.1 as per the “Liberalised Active Retirement Scheme for Guaranteed Employment for Safety Staff (LARSGESS)

inspite of the fact that the applicants have made representation therefor.

The learned counsel for the applicants submits that in view of the Scheme under reference, the applicants are entitled for the relief sought for in

their representation.

Issue notice. Shri Krishan Kant Sharma, learned counsel who appears for respondents, accepts notice.

Learned counsel for the applicants submits that the applicants will be satisfied if the present OA is disposed of at this very stage with a direction to

the respondents to consider the applicants’ representation dated 02.03.2020 (Annexure A-

1) in a time bound manner. To such request of the learned counsel for the applicants there is no objection from the respondents’ learned counsel.

In view of the aforesaid, without going into the merits of the claim of the applicant, the present OA is disposed of with a direction to the respondents

to consider the applicants’ aforesaid representation dated 02.03.2020 (Annexure A-1) and to dispose of the same by passing an appropriate

reasoned and speaking order, as expeditiously as possible and in any case within four weeks from the date of receipt of a copy of this order.

The OA is disposed of in the aforesaid terms. No costs.
