Judgment
This appeal has been preferred against order of the State PCB dated 17.09.2021 levying compensation of Rs. 5,50,000/- for discharge of effluent in violation of laid down standards and thereby causing water pollution. The impugned order is followed by Recovery Certificate dated 05.05.2022 addressed to the Collector, Kanpur to recover the amount of Rs. 6,05,000/- towards the compensation and other dues.
We have considered identical issue by separate order today in Appeal No. 32/2022, M/s Sannu Enterprises v. Central Pollution Control Board & Ors. and held that the amount of compensation needs to be revisited. The contentions raised in the present Appeal are identical.
Accordingly, we dispose of this Appeal also in same terms except that the amount of interim compensation to be deposited by the appellant will be Rs. 75,000/- with the State PCB to be used for restoration of environment in the same manner.
Since we have not found it necessary to issue notice in the facts and circumstances of the case, if the state PCB is aggrieved, it will be at liberty to move this Tribunal.
A copy of this order be forwarded to the State PCB by email for compliance.
I.A. No. 159/2022 also stands disposed of.
