Judgment

The respondents herein had moved O.S.No.51 of 2023 before the II Additional District Judge, Madanapalle, for specific performance of an agreement of sale. Along with the suit, they had also moved I.A.No.809 of 2023, for grant of temporary injunction restraining the petitioners herein from alienating the suit schedule property. This application was allowed by an order dated 30.10.2023. The petitioners, thereupon, moved a vacate petition. Subsequently, the petitioners moved the present Civil Revision Petition against the orders of the trial Court, dated 30.10.2023 in I.A.No.809 of 2023, on the ground that the vacate petition was not being considered.
In view of the pendency of the vacate petition, it would not be appropriate to take up the Civil Revision Petition.
Accordingly, this Civil Revision Petition is disposed of with a direction to the trial Court to consider and pass orders on the vacate petition, filed by the petitioners, in accordance with law and after ascertaining the maintainability of the said vacate petition. The said exercise is to be completed within a period of four months from the date of receipt of this order.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
