An application has been preferred by the applicant for appointment of a fresh Arbitrator on account of the fact that the Arbitrator appointed by the co-ordinate Bench of this Court vide order dated 06.09.2021 passed in S.B. Civil Arbitration Application No.35/2020, has expressed his inability to act as an Arbitrator.

Vide order dated 06.09.2021, Hon’ble Mr. Justice N.P. Gupta (Retired) was appointed as an Arbitrator in the proceedings but, vide letter dated 03.03.2022 received by the Registry, Hon’ble Mr. Justice N.P. Gupta (Retired) has expressed his inability to act as an Arbitrator in the present case. Resultantly, a fresh Arbitrator needs to be appointed in terms of the order passed by the co-ordinate Bench of this Court on 06.09.2021.

Mr. Vinay Kothari, learned counsel for the respondents has not objected to the application preferred by the applicant.

In the circumstances, Mr. Lokesh Mathur, Advocate R/o 12/44, Chopasani Housing Board, Near Vaundhara Hospital, In Front of SBI Bank, Jodhpur is appointed as an Arbitrator on the same terms and conditions as the order dated 06.09.2021 passed by the co-ordinate Bench of this Court S.B. Civil Arbitration Application No.35/2020.

The present misc. application stands disposed of in the terms above.
