The present Petition has been filed under Sections 14 and 15 of the Arbitration and Conciliation Act, 1996, seeking appointment of a substitute Arbitrator in view of the communication dated 29.11.2025, whereby the learned Arbitrator has intimated that, due to time constraints arising from other pending arbitration proceedings, he is unable to accept the mandate.
The Respondent stands served and was afforded an opportunity to file a reply to the present Petition.
However, no reply has been filed and none has entered appearance on behalf of the Respondent since the inception of the present proceedings.
In view of the above, this Court is of the opinion that there is no impediment in granting the relief as sought for.
The total value of the underlying disputes is stated to be approximately Rs. 27 lakhs.
Accordingly, Ms. Vrinda Pathak, Advocate (Mobile No.9650734208) is appointed as the Sole Arbitrator to adjudicate the disputes inter se the parties.
The present Petition, along with all pending application(s), if any, stands disposed of in the aforesaid terms.
