Judgment
A.A. Desai, C.J. and M.C. Jain, J.—The petitioner has retired from respondent-company, which is a Government of India undertaking. For the retirement benefits, initially the petitioner filed a petition. The Court by order dated 24.8.1998 directed the respondent-company to decide the representation on 1 1.12.1998, respondent-company decided the representation. The claim was virtually accepted. However, the company expressed inability to make payment owing to financial condition. Learned counsel for the respondent-company Sri Lalit Belwal contended that after making some payment, the balance amount is roughly 3,00,000 (three lacs).
We direct the respondent-company to make payment of balance amount of Rs. 3,00,000 within a period of three months. Miss Seema Sirohi insisted that payment should carry interest @ 18%. Having regard to the financial condition of the respondent-company, it will not be possible to entertain the claim of interest. However, the net amount of Rs. 3,00,000 as indicated shall be paid within the period as stipulated above.
The petition is accordingly allowed.
