Judgment
The appellant filed S.A. bearing no.94/2025 which is stated to be pending before DRT-II, Chandigarh. DRT-II, Chandigarh vide order dated 27.05.2026 dismissed I.A. No.61/2026 whereby a prayer was made by the appellant for seeking interim relief regarding taking over of the possession of the subject property.
Sh. Vishal Chhabra, Advocate on behalf of the respondent no.1 (now represented through Reforms Assets Reconstruction Company Limited) stated that the possession of the subject property is scheduled to be taken on 15.07.2026 and the property has already been put on auction on 18.02.2026. He further stated that the possession of the property after taking from the appellant shall be handed over to the auction purchaser Manju Chaudhary. Manju Chaudhary appearing through VC stated that after getting possession of the subject property she will not create any third party interest in the subject property till the disposal of the S.A. or without prior permission from this Tribunal or DRT.
Sh. Pallav Saxena, Advocate for the appellant stated that till the disposal of the S.A. bearing no.94/2025 the possession and the title of the subject property be protected by the auction purchaser Manju Chaudhary and the DRT be directed to decide the S.A. bearing no.94/2025 as early as possible and the pleas and contentions of the appellant be kept open to be taken before DRT. Liberty as prayed for is granted.
The present appeal is disposed of with liberty to the respondent no.1 that it may take the possession of the subject property on 15.07.2026 as already scheduled and may hand over the possession thereof to the auction purchaser Manju Choudhary. The auction purchaser Manju Choudhary, after receipt of the possession of the subject property is directed to maintain status quo regarding title and possession of the subject property and not to create any third party interest in respect of the possession and title till the disposal of the S.A. bearing no.94/2025 or without prior permission of this Tribunal or DRT. DRT-II, Chandigarh is directed to decide the S.A. bearing no.94/2025 expeditiously without any unnecessary delay.
