Ms. Savinder Kaur vs Indian Overseas Bank

The appellant filed S.A. bearing no.65/2020 titled as Savinder Kaur v. Indian Overseas Bank which was ordered to be dismissed vide order dated 01.09.2020. The appellant being aggrieved filed the present appeal.

Sh. Vishal Chhabra, Advocate for financial institution stated that the possession of the subject property is scheduled to be taken on 15.07.2026 and the subject property has already been auctioned in favour of Manju Chaudhary who is present in person. It is further stated that after taking possession of the subject property it will be handed over to the auction purchaser Manju Chaudhary. The auction purchaser Manju Chaudhary stated that she after getting the possession of the subject property will not create any third party interest in it and will also maintain status quo regarding possession and title till the disposal of the present S.A. and if she is to sell the subject property she will take prior permission from this Tribunal or DRT.

Sh. Pallav Saxena, Advocate for the appellant stated that the present appeal may be disposed of with direction the auction purchaser not to dispose of the subject property after taking over the possession and it can only be done subject to the outcome of the final decision in S.A. bearing no.94/2025.

Accordingly, the present appeal is disposed of with direction to the auction purchaser Manju Choudhary to maintain status quo regarding title and possession of the subject property and not to create any third party interest in respect of the possession and title till the disposal of the S.A. bearing no.94/2025 or without prior permission of this Tribunal or DRT, after receipt of the possession of the subject property.
