The instant Civil Miscellaneous Petition has been filed for restoration of intra-court appeal being L.P.A. No. 106 of 2024, which stood dismissed for default on 06.08.2024 for non-compliance of order dated 23.07.2024.
Learned counsel for the petitioner has submitted that the intra-court appeal being L.P.A. No. 106 of 2024, which stood dismissed for default on 06.08.2024 for non-compliance of order dated 23.07.2024, may be restored to its original file otherwise the petitioner may suffer irreparable loss and injury.
This Court, having heard the learned counsel for the petitioner and considering the submission advanced on his behalf as also the reason assigned in the instant Civil Miscellaneous Petition, deems it fit and proper to restore the intra-court appeal being L.P.A. No. 106 of 2024, which stood dismissed for default on 06.08.2024 for non-compliance of order dated 23.07.2024, to its original file.
In view thereof, the intra-court being L.P.A. No. 106 of 2024 is restored to its original file, subject to compliance of order dated 23.07.2024, within two weeks.
Accordingly, the instant Civil Miscellaneous Petition stands disposed of.
