Judgment
Aparesh Kumar Singh, J. - Counsel for the petitioner is permitted to remove the surviving defects during course of the day.
Heard counsel for the parties.
Petitioner seeks extension of interim protection given to it by order dated 14.03.2016 passed in WPC No. 1001/2016 for approaching the Revisional Authority for any interim relief in respect of the main matter which is pending before the Revisional Authority where Memo No. 194 dated 22.01.2016 issued by the Department of Mines and Geology, Government of Jharkhand rejecting the extension of lease of Iron Ore and Manganese over an area of 640 acres at Mouza Baraiburu, Tatiba Singhbhum West under section 8A(6) of the Mines and Minerals (Development and Regulation) Act, 1957 as amended by the Mines and Minerals (Development and Regulation) Act, 2015 is under challenge.
Learned counsel for the petitioner submits that the petitioner has with all promptitude filed his application for interim stay on 22.03.2016 (Annexure-2), but the Revisional Authority has not taken up the matter by now and the period of interim protection of three weeks would be over. Petitioner apprehends coercive steps. Therefore, interim protection may be extended till the application for interim stay before the Revisional Authority is taken up.
Learned A.A.G. Mr. Jai Prakash, appearing on behalf of the State, submits that the import of the order dated 14.03.2016 is to provide protection to the petitioner for a period of three weeks from any coercive action only to enable it to prefer an interlocutory application for interim relief, which he has already preferred.
He also submits that there are apparently no emergent reason for the petitioner to apprehend coercive action.
Be that as it may, upon consideration of rival pleas of the parties and order dated 14.03.2016, such a prayer for further extension of time does not seem to be made out from the order itself, as the petitioner has already approached the Revisional Authority with interim application in the pending Revision Petition No. 06/(08)/2016/RC-1. Counsel for the State also removes any doubt about emergent coercive steps to be taken in the matter against the petitioner.
CMP is accordingly disposed of with the aforesaid observations.
