Hon’ble Mrs. Manjula Das:

In these three O.As., common question of law and facts arise. Hence, they are disposed of through this common judgment.

The Delhi Subordinate Services Selection Board initiated steps for selection and appointment to various posts, including the post of Trained Graduate Teacher (Physical Education) vide Post Code Nos.87/20 and 80/20, through Vacancy Notice/Advertisement No.04/2020 dated 04.01.2020. The applicants applied for the said post.

Learned counsel for applicants submitted that the applicants fulfilled all the eligibility conditions and they have submitted the requisite applications along with all the required documents and have also paid the requisite fee. However, for the reasons best known to them, the respondents have not issued the admit cards to the applicants till date in spite of the fact that the relevant examination is scheduled for 02.08.2021.

Learned counsel for applicants also referred to the interim orders passed by this Tribunal on 20.07.2021 in Monika Sharma v. DSSSB & others and 30.07.2021 in O.A. No.1480/2021, wherein the Tribunal has directed the respondents to issue the admit cards to the applicants therein.

On the other hand, Ms. Esha Mazumdar, learned counsel for respondents submitted that though the applicants have filed these O.As. on 02.08.2021, by the time the O.As. could be taken up, the examination had already been held, and the applicants cannot now be permitted to appear in the examination.

Heard Mr. G K Chauhan, learned counsel for applicants and Ms. Esha Mazumdar, learned counsel for respondents.

From the perusal of the records, it is seen that the examination for the said post has already been held by the respondents on 02.08.2021 and we do not intend to grant any relief to the applicants in this behalf. However, we dispose of these O.As., giving liberty to the applicants to prefer a comprehensive representation to the respondents in this behalf within one week from day. On receipt of such representation from the applicants, the respondents shall pass a speaking and detailed order within one month thereafter.

There shall be no order as to costs.
