Mr. Ajit Kumar, learned senior counsel for the petitioner submits that he has already served a copy of the writ petition upon Mr. Deepak Kr. Bharti, learned counsel appearing for the respondent no. 5. So far as the rest respondents are concerned, it has been submitted that the copies of the writ petition shall be served upon them today itself.
Submission has been advanced by the learned senior counsel for the petitioner while referring to the impugned letter dated 23.05.2022 that the agreement has been terminated as per clause 59.4 of GCC which includes forfeiture of Performance Guarantee, Security Deposit as well as black listing the petitioner for a period of three years from participation of tenders in NPCC. Learned senior counsel submits that so far as the Performance Guarantee is concerned, the same has already been invoked and as regards the mobilization guarantee is concerned, the same does not find mention in the impugned letter dated 23.05.2022.
Since some of the respondents have not been served with a copy of the writ petition as yet and as assured by Mr. Ajit Kumar, learned senior counsel for the petitioner that they shall be served with copies of the writ petition today itself, let this case be listed on 03.06.2022 under the same heading.
