Judgment
Tarlok Singh Chauhan, J
The instant petition has been filed for grant of the following reliefs:
"i) That the respondent may be directed to consider the case of the petitioner for grant of Consent to Operate the Stone Crusher in light of annexure P-2 ( mining lease) and annexure P-5(permanent registration) certificate.
ii) That the respondent may be directed to grant the Consent to Operate on the same analogy, on the basis of which earlier Consent to Operate was granted to the petitioner by the respondent vide annexure P-7."
It appears that the only ground on which the petitioner was not granted Consent to Operate the Stone Crusher was that there was a shortfall in the deposit of fee for 'Renewal of Consent to Operate' (ROCTO). The learned counsel for the petitioner undertakes to file a fresh application along with the requisite fee within a period of two weeks. In case, the needful is done within the stipulated period, then the respondent shall consider the case of the petitioner for grant of Consent to Operate the Stone Crusher strictly in accordance with law within further period of two weeks from the date of such deposit.
The writ petition stands disposed of in the aforesaid terms, so also the pending application, if any.
