The vehicle of the petitioner bearing No.MH34BG7789 has been seized by the 2nd respondent in Crime No.281 of 2022, registered by the 2nd respondent. The offence set out in the complaint is that there was an illegal excavation of sand and transporting sand in the vehicle of the petitioner.
In similar circumstances, this Court dealing with cases where vehicles have been seized for illegal transport of sand, had passed directions and for release of the vehicle subject to payment of the penalty under G.O.Ms.No.71 Industries, Infrastructure, Investment and Commerce (Mines-II) Department, dated 04.09.2019. An order of that nature passed in W.P.No.8461 of 2021 dated 16.04.2021 has been relied upon by the petitioner.
Following the said order, this writ petition is disposed of with a direction to the 2nd respondent to release the vehicle of the petitioner on payment of the penalty under G.O.Ms.No.71 dated 04.09.2019. There shall be no order as to costs.
Miscellaneous petitions, pending if any, shall stand closed.
