This Civil Revision Petition is filed by the petitioner against the order dated 29.02.2024 in E.P.No.69 of 2023 in O.S.No.573 of 2018, passed by the learned II Additional Senior Civil Judge, Kakinada/Executing Court in respect of the delivery warrant ordered by the executing Court in pursuance of the decree passed by the trial Court in O.S.No.573 of 2018, which was confirmed by the First Appellate Court. Aggrieved against the said judgment and decree passed in A.S.No.66 of 2023, the appellant in the first appeal filed the second appeal vide S.A.No.194 of 2024, before this Court.
When the matter came up for hearing on 14.03.2024, this Court ordered “the stay of the execution proceedings subject to the result of the second appeal in S.A.No.194 of 2024”. Since, the second appeal in S.A.No.194 of 2024 is dismissed by this Court vide its Judgment dated 10.12.2025, the present Civil Revision Petition has become infructuous and the same has to be closed.
Accordingly, the present Civil Revision Petition is closed. Pending applications, if any, shall stand closed. No costs.
